
Digital Nomad
Initial Request
The residence authorisation for international teleworkers, also known as digital nomads, allows you to live in Spain for a period of more than 3 months while working for a company abroad.
This authorisation can be requested directly from Spain (if you are in a regular situation, for example, within your tourist stay period) or from abroad, through your corresponding Spanish consulate.
Requirements
From the Applicant
๐ Not be a citizen of the EU, EEA or Switzerland, or a family member of citizens of these countries.
๐ Be of legal age.
๐ซ Not being listed as inadmissible in Spain or the Schengen Area.
๐ผ Have an employment or professional relationship with a foreign company/companies for at least the 3 months prior to the application.
๐ป Be able to carry out the activity remotely through the exclusive use of computer systems and electronic means.
๐ถ Sufficient financial means.
๐ฉบ Health insurance arranged with an insurance company authorised to operate in Spain.
From the Company
๐ข Have an established minimum existence of one year that is demonstrable and real.
๐บ๏ธ Be based outside Spanish territory (it must not have either a branch or a subsidiary in Spain).
โ ๏ธ Only in the event that it is a professional/commercial relationship (self-employed work), will the worker be permitted to provide services to a company located in Spain, provided that the percentage of this work represents, at most, 20% of the total work activity.
Documents
๐ MIT application form.
๐ฐ Payment of the fee Form 790 Code 038.
๐ชช Full copy of the valid passport, registration certificate or travel document, recognised as valid in Spain.
๐ฎ๐ผโโ๏ธ Criminal record certificate issued by the Authorities of the country or countries in which the applicant has resided during the five years prior to the submission of the application.
โ๐พ Responsible declaration, signed by the applicant, declaring the absence of a criminal record in the countries where they have resided for the last five years.
โ ๏ธ These last two documents will not be required if the applicant already holds a residence or stay authorisation in Spain of more than 6 months and has already submitted them in their previous application.
Specific Documents
Professional Accreditation
You must prove that you have had an employment or professional relationship for at least three months and that you have the qualifications or experience for the job in question:
๐ชช Proof of employment / professional relationship for at least three months.
๐ Documentation proving a minimum qualification or experience of three years in functions analogous to the remote position.
๐ Curriculum vitae.
Company Accreditation
The company must be based outside Spain and must authorise you to work remotely:
๐ข Company certificate (Commercial Registry) or equivalent official document from the country of origin proving that the company has a real and continuous activity of at least one year.
โ๏ธ Authorisation letter (remote work permit) issued by the company authorising work from Spain.
Proof of Financial Resources
Financial means must be equivalent to at least 200% of the Minimum Interprofessional Wage (SMI) in gross monthly value. To verify that the applicant meets these requirements, they must present:
๐งพ Payslips or invoices from the last three months.
๐ฆ Original bank certificate, stamped or signed, proving receipt of said income.
Proof of Social Security Coverage and Healthcare
The way to prove this requirement will depend on your employment status (employed or self-employed) and whether a bilateral/multilateral agreement exists with your country of origin:
Self-Employed Workers
There is only one option, which consists of registering with Spanish Social Security. The following must be provided:
โ๐พ Responsible declaration of registration with the Special Regime for Self-Employed Workers (RETA) before starting the activity.
Employed Workers
They have a double option to prove that they contribute to Social Security (in Spain or in the country of origin) and that they have healthcare coverage in Spain (derived from their contributions to the Spanish Social Security or that they are covered by the social security system of their country of origin).
Registration with Spanish Social Security
Under this route, as they have healthcare coverage through the Spanish public system, it is not necessary to take out private medical insurance. The following must be provided:
๐ก๏ธ The registration of the foreign company with Spanish Social Security as a foreign company without a permanent establishment.
๐ซฑ๐ผโ๐ซฒ๐พ The formal commitment to register the worker in the General Regime.
Maintenance of Social Security in the Country of Origin
In this case, it will be necessary to rely on a bilateral, multilateral agreement or international Social Security instrument applicable and signed by Spain:
๐ Certificate of applicable legislation issued by the corresponding social security institution of the country of origin explicitly indicating that it covers the displacement to work remotely from Spain.
Regarding healthcare, it will be necessary to consider whether the international regulation coordinating social security systems also provides healthcare coverage for the applicant in Spain:
๐ Certificate of entitlement issued by the competent institution of the State in whose social security system the applicant is insured, if they are covered.
๐ฉบ Public or private health insurance, if they are not covered, contracted with an insurance entity authorised to operate in Spain that provides coverage comparable to the Spanish National Health System.
โ ๏ธ Travel insurance, reimbursement-only policies, co-payments or waiting periods are not accepted.
