The residence authorisation for family members of digital nomads allows your family members to accompany you to live in Spain while you work remotely for a company located abroad.

This authorisation can be applied for at the same time as the holder's (jointly) or subsequently (when the digital nomad already has their permit and is already in Spain). The procedure can be carried out directly from Spanish territory (if the family member is in a regular situation, for example, as a tourist) or from abroad, through the corresponding Spanish consulate.

Requirements

Of the Digital Nomad

📄 Apply jointly and simultaneously, together with your family members, for the international teleworker (digital nomad) visa/authorisation, or be a holder of a visa/authorisation.

👨‍👩‍👧‍👦 Have a family relationship with the relative for whom the authorisation is requested of any of the following types: 

  • Spouse. 

  • Registered partner.

  • Unregistered partner.

  • Descendants under 18 years of age. 

  • Descendants over 18 and under 26 years of age, who are financially dependent. 

  • Descendants over 26 years of age, with disabilities and financially dependent.

  • Dependent ascendants. 

💶 Have the financial means both for yourself and for your family members.

🩺 Have health insurance contracted with an insurance company authorised to operate in Spain, both for yourself and for your family members.

Of the Family Member

🌍 Not be a citizen of the EU, EEA or Switzerland, or a family member of citizens of these countries.

🚫 Not be listed as inadmissible in Spain or the Schengen Area.

📄 MIF application form.

💰 Payment of the fee Form 790 Code 038.

🪪 Full copy of the valid passport, registration certificate or travel document, recognised as valid in Spain.

Specific Documents

Proof of Family Relationship

The family relationship between the permit-holder and the family member must be proven, as applicable:

💍 Spouse: Marriage certificate.

📄 Registered civil partners: Certificate of registration of the partnership in a public register.

🏠 Unregistered civil partners: Proof of stable and continuous marital cohabitation for at least one year immediately preceding the application (by means of municipal registration, joint accounts, shared rent or mortgage, etc.). If there is registered common offspring, i.e. children, the year of cohabitation is not required, but proof of current cohabitation is.

👶🏼 Descendants under 18 years of age: Birth certificate. If travelling with only one parent, express notary authorisation from the other permitting residence in Spain.

👧🏽 Descendants over 18 years of age (up to 26 years): Birth certificate, proof of financial dependence (negative certificate issued by the competent social security and tax authorities of the country of origin), proof that they are studying in or from Spain or that they are registered in an active job search, and certificate of single status.

👦🏻 Descendants over 26 years of age: Birth certificate and clinical/official documentation proving an objective disability that prevents them from being financially independent.

👵🏿 Ascendants: Birth certificate of the holder/spouse proving the relationship and documentary evidence that the ascendant is dependent on the main applicant.

Proof of Financial Resources

🧾 Payslips or invoices from the last three months.

🏦 Original bank certificate (stamped/signed) proving the receipt of said income. 

Proof of Health Coverage

The digital nomad must have health insurance (public or private) and their family members must also have it. Depending on the circumstance, there are two alternatives: 

  1. Public Health Insurance

❌ If the digital nomad, once the authorisation has been obtained, commits to register with Social Security, and the family member has the right to be a beneficiary of the permit-holder, it will not be necessary to provide any document. 

🧾 If the digital nomad has already obtained the authorisation, and has registered with Social Security, they must present a copy of the Social Security registration resolution and the certificate of being up to date with payments to Social Security. 

📄 If the digital nomad is covered by an international social security coordination regulation that provides for healthcare coverage, a certificate of entitlement issued by the competent social security institution in their country proving that the family member is a beneficiary of the holder's right must be provided. 

  1. Private Health Insurance

🩺 Private health insurance policy, contracted with an insurance entity authorised to operate in Spain.

⚠️ It must provide coverage equivalent to that of the Spanish National Health System.

⚠️ Travel insurance, reimbursement-only policies, co-payments or waiting periods are not accepted.

Proof of Criminal Record Certificate

👮🏼‍♂️ Criminal record certificate issued by the authorities of the country or countries in which they have resided during the five years prior to submitting the application.

✍🏾 Responsible declaration, signed by the applicant, declaring the absence of a criminal record in the countries in which they have resided for the last five years.

⚠️ These documents will not be required if the applicant already holds a residence or stay permit in Spain for more than 6 months and already provided them in their previous procedure.
