
Labour Roots (Arraigo)
Labour roots (arraigo sociolaboral) is a temporary residence permit granted for exceptional circumstances that can be given to foreign citizens who are in Spain in an irregular administrative situation. It is granted to those people who have one or more employment contracts that guarantee, at a minimum, the minimum wage (or the one established by the collective agreement) and represent a weekly working time of no less than twenty hours.
This path allows you to regularise your administrative situation if you have been in the country continuously for a minimum period of two years.
Requirements
🌎 Not being a citizen of the European Union, EEA (Iceland, Liechtenstein and Norway) or Switzerland, or a family member of citizens of these countries to whom the EU citizen regime applies.
🇪🇸 Being in Spain and not having the status of an international protection applicant (neither at the time of submission nor during processing).
🚓 Not pose a threat to public order, security, or public health.
⚖️ Lack of a criminal record in Spain and in the countries where the person has resided in the last five years, for crimes existing in Spanish law.
🚫 Not being listed as inadmissible in the Schengen Area.
🛑 Not being within the commitment to non-return period to Spain.
🗓️ Having continuously resided in Spain for at least the two years prior to the submission of the application.
📃 Having one or more employment contracts, for a minimum of 20 hours per week and guaranteeing the minimum wage or the wage established in the applicable collective agreement, in proportion to the working hours.
⚠️ The provision of more than one employment contract is accepted:
In the case of seasonal or temporary jobs → two or more contracts can be submitted, with different employers and linked (when one contract ends, the next begins).
In the case of having two jobs at the same time → contracts related to activities of the same or different occupation can be submitted, working part-time and simultaneously for more than one employer.
In both cases, the total number of weekly hours and salary must meet the minimum specified above.
📊 The employer must be up to date with the fulfilment of their tax obligations and with Social Security and have sufficient economic, material, and personal means for their business project and to meet the obligations assumed with the employer.

🪪 Complete copy of the passport, registration card or valid travel document recognised as valid in Spain.
🇪🇸 Supporting documentation of continuous residence in Spain for a minimum period of two years.
👮🏼♂️ Criminal record certificate issued by the authorities of the country or countries where you have resided during the last five years prior to the submission of the application.

🗃️ Copy of employer's or representative's NIF and, where applicable, a copy of the company's bylaws.
📂 Copy of the IRPF, VAT, IS or VILE filings.
Employee-Related
📄 Contract or employment contract with the required characteristics, signed by the employer and employee.
👔 Copy of the documentation that certifies the training and, where applicable, the professional qualification legally required to practice the profession, as well as the homologation and/or recognition for practicing a regulated profession in Spain.
⚠️ Applies only if the job involves exercising a regulated profession.
Regulated professions include those such as: doctor, veterinarian, nurse, dentist, pharmacist, psychologist, engineers, architects, teachers, professors, lawyers, etc…
