Social Roots (Arraigo)
Social roots (arraigo) is a temporary residence authorisation for exceptional circumstances that may be granted to foreign citizens who are in Spain in an irregular administrative situation. It is granted through two main pathways:
Having family ties with a person who has a residence authorisation with sufficient economic means, or
The provision of the integration effort report issued by the corresponding Authority.
This pathway allows you to regularise your administrative situation if you have remained in the country continuously for a minimum period of two years.
Requirements
🌎 Not being a citizen of the European Union, EEA (Iceland, Liechtenstein and Norway) or Switzerland, or a family member of citizens of these countries to whom the EU citizen regime applies.
🇪🇸 Being in Spain and not having the status of an international protection applicant (neither at the time of submission nor during processing).
🚓 Not pose a threat to public order, security, or public health.
⚖️ Lack of a criminal record in Spain and in the countries where the person has resided in the last five years, for crimes existing in Spanish law.
🚫 Not being listed as inadmissible in the Schengen Area.
🛑 Not being within the commitment to non-return period to Spain.
🗓️ Having continuously resided in Spain for at least the two years prior to the submission of the application.
🫱🏼🫲🏾 Proving one of the following situations:
Have family ties with other foreigners holding a residence permit (spouse or registered partner and first-degree relatives in direct line) and justifying sufficient economic means for their support.
Proof of the social integration effort of the foreigner, backed by a favorable report that may be issued by the Autonomous Communities or, if applicable, by the Municipalities, in whose territory the foreign person has their habitual residence.

Depending on the situation that the interested party is applying for:
Documentary evidence of the required family ties (marriage certificate or civil partnership registration, updated, birth certificate or other documents).
Integration effort report issued by the Autonomous Community or, if applicable, by the City Council, in whose territory the applicant has his habitual residence.
💶 Documentary Evidence of Means of Subsistence
Economic means can be demonstrated in three main ways, depending on the situation you find yourself in and the origin of the means. Here we summarise them for you, with more details for each in the following sections.

If the residence is requested based on family ties, with economic means from the family member:
The family member with legal residence, regarding whom the tie is accredited, must demonstrate at least an amount equivalent to 200% of the IPREM, 100% of the IPREM for themselves and the remaining 100% for the applicant of the residence. These economic means must be available in Spain.
If the residence is requested based on the integration effort report, with own economic means:
100% of the IPREM must be demonstrated. These economic means must be available in Spain.
Regardless of the circumstance based on which the residence is requested, if the economic means come from a self-employed activity:
Documentary evidence related to the self-employed activity to be initiated must be provided, depending on the case. This is done through the documentation that applies according to the activity to be carried out:
Documentary evidence of licences and activities:
In retail commercial activities and provision of the services listed in the Annex of Law 12/2012, of 26 December, carried out in permanent establishments, whose usable area is equal to or less than 750 square meters, responsible declaration or prior communication (in the terms of the article 69 of Law 39/2015, of 1 October) and, where applicable, proof of payment of the corresponding tax.
In other activities and professional service provisions, a list of the authorisations or licences required for the installation, opening, or operation of the projected activity or for the professional practice, indicating the status of the procedures for their granting, including, where applicable, the application certificates before the corresponding bodies.
A copy of the documentation proving the required training and, where applicable, the legally required professional qualification for exercising the profession, as well as the homologation and/or recognition, and if applicable, registration for the exercise of the profession in the case of regulated professions in Spain.
A copy of the documentation proving the sufficiency of the planned investment for the implementation of the project and about its impact, where applicable, on job creation, including self-employment.
The last two sections can be evidenced by the valuation report issued by one of the recognised self-employed organisations such as: ATA, UPTA; CIAE, OPA or UATAE.
